Bullying Rap Against Vargas Child’s Classmate Dismissed

The Quezon City Prosecutor’s Office has dismissed the criminal complaint filed by spouses Alfred and Yasmine Vargas over the alleged bullying of their child by the family of Rob Sy, citing lack of evidence.

Sy confirmed the dismissal in a Facebook post on Wednesday, saying the complaint against him and his wife was junked on May 12.

The case stemmed from the Vargas couple’s complaint for alleged violation of Section 10(a) of Republic Act No. 7610, or the Special Protection of Children Against Abuse, Exploitation and Discrimination Act. They accused Sy’s son of bullying their child and claimed that Sy and his wife failed to properly supervise and discipline their child.

In the resolution shared by Sy, prosecutors said the allegation appeared to rest only on speculation.

“The complainants argued that the respondents’ alleged failure to supervise and discipline their child caused the predicament suffered by their child. However, such an argument appears to be based merely on speculation. Allegations alone do not constitute evidence,” the prosecution said.

The prosecutor’s office also found no prima facie evidence or sufficient basis to charge the respondents under RA 7610.

Sy welcomed the dismissal, describing it as a vindication for his family, especially his child.

“From the very beginning, we maintained that this complaint was a calculated ‘narrative reversal’ and an attempt to twist the real overall story using media portrayals and emotional theatrics instead of objective facts and real evidence,” Sy said.

He said his family chose not to engage in public drama despite online hostility, cyberbullying, and what he called premature judgment from some individuals.

Sy acknowledged that the complaint may still be appealed or may go through further legal proceedings, but said the dismissal was an important step for his family.

“Although we understand from our lawyer’s explanation that this may still be appealed or may go through a longer legal process, this dismissal is an important and necessary vindication for our family, especially for our child,” he added.
