House prosecutor and Akbayan Party-list Rep. Chel Diokno has maintained that confidentiality rules covering Anti-Money Laundering Council (AMLC) records cannot shield them from a lawful subpoena of the Senate impeachment court.
Diokno emphasized that the impeachment court possesses the legal authority to compel the production of financial documents relevant to the trial. He noted that statutory secrecy protections for banking records yield to the constitutional mandates of the Senate when sitting as an impeachment tribunal.
“The confidentiality surrounding AMLC records is not absolute,” Diokno said.
He also said that the Senate impeachment court has broad powers to ensure a full and fair trial, including issuing subpoenas for financial intelligence.
