House prosecutor and Mamamayang Liberal Party-list Rep. Leila de Lima said there is no basis for claims that “surprise witnesses” will be presented in the impeachment trial of Vice President Sara Duterte, stressing that both sides have already disclosed their evidence and witnesses during pre-trial proceedings.
De Lima said the prosecution has already identified its witnesses and documentary exhibits in its pre-trial brief submitted to the Senate impeachment court, making it unlikely for either party to claim being ambushed during trial proper.
“So there can be no questions about, ‘well it’s a surprise witness, we’re being ambushed here by a surprise witness,’” she said.
The lawmaker made the statement following discussions on a proposed rule requiring both prosecution and defense panels to give at least three days’ notice before presenting witnesses in court.
She clarified that the proposal did not originate from the House prosecution team but was raised by the defense panel.
“Gusto ko pong linawin na itong requirement na ito, itong proposal na ito ay actually hiling po ‘yan ng defense. Hindi po ‘yan hiling ng prosecution,” she emphasized.
She added that the prosecution saw no need for the additional requirement, citing the prior submission of its witness list and documentary evidence as part of the pre-trial process.
According to De Lima, both parties are already aware of the expected testimony and evidence to be presented once the trial begins.
“Kasi sa tingin po namin ay nandiyan naman, alam na nila kung sino ‘yung mga witnesses namin. Alam na nila kung ano ‘yung mga ebidensya,” she said.
Despite this, De Lima said the prosecution agreed to the proposed notice rule in order to avoid procedural disagreements that could delay the proceedings.
“Pero ‘yun na nga para wala nang mga ganoong usapan that could further delay the proceedings, pumayag po kami,” she added.
The Senate impeachment court is currently conducting pre-trial activities ahead of the formal start of proceedings on July 6.
