Romualdez demands Tulfo retract false jail exit claims

Allegations of improper privileges and custody protocol breaches within state detention facilities have highlighted ongoing oversight requirements governing security compliance and administrative accountability for high-profile detainees.

Former Speaker and Leyte Representative Ferdinand Martin G. Romualdez has formally demanded that broadcaster Ramon Tulfo immediately retract his allegations that the former House leader secretly leaves his detention facility in Quezon City.

Lawyers of Romualdez likewise warned that legal action will follow if the journalist continues spreading the claims or fails to comply with the demands of his lawyers.

In a letter dated November 4, lawyer Felix Michael U. Villa of Solis Medina Fajardo Malilong demanded that Tulfo cease publication and dissemination of the allegations contained in his November 3 Facebook post, with the formal notice addressed to the broadcaster through the Ramon Tulfo Good Samaritan Foundation Inc.

The Facebook post, captioned “Inilahad ng aking tweety bird kung paano pinalalabas si dating Speaker Martin Romualdez sa kulungan,” claimed that Speaker Romualdez secretly leaves and returns to the New Quezon City Jail through a backdoor staircase leading to a waiting ambulance, supposedly with the jail warden cutting electricity throughout the facility to prevent security cameras from recording his movements.

“Our Client categorically and unequivocally denies these allegations. Our Client has not left the New Quezon City Jail at any time since he was committed there on 14 September 2026, and he remains detained there as of the date of this letter,” the law firm stressed.

The lawyers maintained that the accusations went beyond ordinary gossip because they imputed serious misconduct and extraordinary privileges within a detention facility while also casting doubt on the integrity of the jail officials and personnel responsible for Romualdez’s custody.

“Attributing these claims to an unnamed ‘tweety bird’ does not absolve you,” the lawyers emphasized, arguing that journalists have a responsibility to verify serious allegations rather than rely on unidentified sources to publish damaging accusations against individuals.

Citing the Supreme Court’s Sept. 16, 2008 ruling in Tulfo v. People, G.R. No. 161932, the lawyers invoked the Court’s condemnation of journalists who publish unverified information to damage another person’s reputation and its recognition of the duties to present the other side and promptly correct substantive errors, which the letter maintained Tulfo had failed to observe.

The lawyers made three demands from Tulfo, the first is to “Immediately cease and desist from publishing, republishing, sharing, or otherwise disseminating the Subject Post and the allegations in it,” requiring him to stop further circulation of the disputed claims.

The second demand instructed him to “Refrain from making any further statement or insinuation that our Client has left the New Quezon City Jail,” expressly prohibiting the repetition of allegations that Romualdez had secretly exited the detention facility.

The third demand required Tulfo to “Immediately remove or correct the Subject Post and issue a clear and prominent clarification that its allegations have been categorically denied and are without factual basis,” making a public correction an essential part of the legal notice.

“To be clear, this letter does not seek to curtail legitimate journalism or fair comment. Press freedom, however, is not a license to publish false and malicious accusations,” the lawyers also said, distinguishing responsible reporting and legitimate criticism from the publication of unverified allegations.

“Should you fail to comply, or in case there is a republication of these allegations, our Client shall pursue all available remedies without further notice,” the letter warned, concluding with an expectation of Tulfo’s immediate compliance.

In a subsequent Facebook post, Tulfo acknowledged that he had accepted erroneous information from a source and passed it on to his readers, describing the experience as embarrassing and humiliating because the report had gone viral despite being untrue.

“No such thing happened when the facts started coming in yesterday (Tuesday),” Tulfo admitted, referring to his earlier allegations about Romualdez leaving and returning to jail.

“It was fiction. I goofed,” Tulfo also said, acknowledging that he should have checked and cross-checked the information before publishing it and declaring that he had no excuses, although his public admission contained no apology to Romualdez for the false allegations.
