Escudero Urges Overhaul of Government’s Narrow ‘Indigency’ Label

Senator Francis Escudero is pushing for a sweeping overhaul of how the government defines “indigency,” arguing that rigid, income-only metrics fail to capture the financial ruin faced by middle-class families hit by sudden medical or legal emergencies.

Speaking on his weekend podcast “Chiz Wiz! Usapang May Laman,” Escudero criticized the state’s reliance on equating poverty primarily with enrollment in the Department of Social Welfare and Development’s Pantawid Pamilyang Pilipino Program (4Ps). He stressed that this narrow lens creates an artificial barrier for millions of working Filipinos who earn above the poverty line yet remain completely vulnerable to catastrophic expenses.

“Ano ba talaga ibig sabihin ng indigency? Meaning 4Ps ka ba? Ang problema kasi sa batas natin iisa lang ibig sabihin ng indigency. Pero para sa akin iba’t iba ang level ng indigency,” Escudero said, contending that financial distress should be judged by circumstance rather than static salary caps alone.

Under current laws, the definition of an indigent citizen remains fragmented across public institutions. Local barangays issue indigency certificates under discretionary guidelines of the Local Government Code, the Public Attorney’s Office ties legal aid eligibility strictly to Philippine Statistics Authority poverty metrics and social welfare programs depend on DSWD targeting databases.

This patchwork system frequently locks out gainfully employed professionals, such as teachers and rank-and-file workers, who cannot afford specialized legal fees or life-saving medical care despite holding steady jobs.

To bridge this gap, the veteran lawmaker proposed adopting circumstantial classifications like “cancer-indigent” for families battling severe illnesses or “litigation-indigent” for those seeking judicial relief.

“Kamukha rin nito magpa-file ka ng nullity of marriage, hindi naman ganon kadaling pulutin ‘yung P200,000 to P500,000 na panggastos diyan, di ba? So, litigation-indigent siya. Pag may nagkasakit sa pamilya mo, tulad ng cancer, cancer‑indigent ‘yung pamilya mo,” Escudero explained.

Appearing as a guest on the podcast, litigation lawyer Maggie Garduque supported the initiative, explaining that establishing distinct tiers of indigency is fully allowable under the equal protection clause of the Constitution as long as the distinctions are rational and fair.

Escudero urged lawmakers and executive agencies to abandon the traditional one-size-fits-all model in favor of flexible, real-world standards that ensure public assistance reaches citizens based on the actual financial crises they endure.
