NTC clarifies proposed rules on refurbished gadgets will not eliminate secondhand market

The National Telecommunications Commission (NTC) said the proposed rules on the sale and importation of refurbished mobile devices will not eliminate the second-hand market but seek to protect consumers while preserving access to more affordable gadgets.

The agency said the draft rules aim to ensure that refurbished mobile phones and other devices are properly sourced, refurbished, tested, and sold by licensed dealers, providing consumers with safer and more affordable alternatives amid rising prices of new devices.

“People can still buy or sell their own goods in the market. The NTC is just expanding their options,” Deputy Commissioner Alvin Blanco said.

Under the proposed regulations, consumers may continue to buy, sell, or trade their personal mobile devices among themselves, provided these transactions are not conducted in commercial quantities.

The requirements, including minimum capitalization, will apply only to applicants for a Dealers Permit for Used, Reconditioned, or Refurbished Mobile Devices (DPURRMD).

The NTC said the capitalization requirement is intended to ensure that dealers and importers can provide type-approved, properly refurbished devices and have the financial capacity to honor the mandatory one-year repair or replacement warranty for every unit sold.

The proposed rules would also require refurbished devices to be compatible with mobile network operators in the Philippines, properly sanitized, graded according to their physical condition, and fully functional.

These safeguards are intended to protect consumers against smuggled, stolen, improperly refurbished, and potentially unsafe devices.

The commission said the regulation would allow consumers to access quality refurbished gadgets, including 4G- and 5G-capable mobile phones and laptops, at more affordable prices without removing legitimate second-hand trading from the market.

Beyond consumer protection, the proposed rules would establish procedures for the proper disposal and recycling of mobile devices that are no longer suitable for use.

Following the public consultation, the NTC is evaluating comments and recommendations from stakeholders to refine the draft regulations, taking into account both consumer protection and industry concerns.
